  • Employers that meet the conditions below must submit their reports online:
    • They don't use a tax preparer.
    • They use a computer to prepare, document, or calculate their tax forms.
    • They've got broadband Internet access.

Employers filing this form online, don't need to submit a paper return.

 

    Payable to "NYS Employment Contributions and Taxes"

    • Apr 30, Jul 31, Oct 31, Jan 31 (month end following the end of the quarter).
    • If the due date falls on a Saturday, Sunday or legal holiday, it must be submitted on the first working day AFTER.
    • Employers can choose payment modes here.

    Payment interval:

    • Within three business days following payroll
      • If withholding tax $15,000 or more per year, send payment with Form NYS-1.
    • Within five business days following payroll
      • If withholding tax $15,000 or less per year, send payment with Form NYS-1.
    • Quarterly
      • If employer withheld less than $700 during a calendar quarter, don't remit Form NYS-1. Remit the accumulated tax with this return instead.
    • New employers file within five business days until notified otherwise by the Tax Department.

 

Manual

  • Employers must file this return even if there are no reportable wages or taxes due for the reporting period.
  • Don't adjust a prior period's wages on this report.
  • If the business closes during the year, then this is due within 30 days of the payment of the final wages or discontinuation of business.

Online

  • When filing online, for the 4th quarter, it'll open up Column D & E from Part C.
  • Employers must file this return even if there are no reportable wages or taxes due for the reporting period.
  • Don't adjust a prior period's wages on this report.
  • If the business closes during the year, then this is due within 30 days of the payment of the final wages or discontinuation of business.
